1. Acceptance and scope
These Terms of Use (the "Terms") apply solely to your access to and use of the website published at olivares.ai (the "Website"), operated by Francisco Olivares Martín ("Olivares AI", "we", "us"). By accessing or using the Website you agree to be bound by these Terms. If you do not agree with them, please do not use the Website.
These Terms cover the Website only: an informational and marketing site. They do not govern the use, installation, modification or distribution of the Olivares AI software, which is licensed separately as described in section 2.
2. The software is licensed separately
Olivares AI is an open-core, self-hosted platform for enterprise AI. The software is not provided or licensed through these Terms. Nothing on the Website and nothing in these Terms grants you any license, right, title or interest in the software, in its source code, or in any related intellectual property.
The software is made available under the following licenses, each of which is the sole and governing instrument for the rights it grants:
- The complete product is available free and self-hostable under the GNU Affero General Public License, version 3 (AGPL-3.0).
- A separate commercial license and an enterprise tier are available for organisations that require terms other than the AGPL-3.0.
- The connector SDK is made available under the Apache License, Version 2.0 (Apache-2.0).
3. Use of the Website
The Website is provided for general information about Olivares AI and its software. Its content is offered "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.
Olivares AI is a pre-release company. Nothing on the Website constitutes a guarantee of any compliance outcome and nothing on the Website is, or should be read as, a certification. We are not certified under SOC 2, ISO/IEC 27001, the EU AI Act or any other framework, and we do not claim to be. Where the Website describes practices as "designed toward" a standard, that wording describes a design intention, not an attained certification or a binding commitment.
The information on the Website may change without notice and may contain errors or omissions. You should not rely on it as legal, security or compliance advice.
4. Intellectual property and trademark
Except for material made available under an open-source license, the content of the Website, including text, layout, graphics and design, is owned by Francisco Olivares Martín or its licensors and is protected by intellectual property laws. You may view and use the Website for your own information and for the purpose of evaluating Olivares AI, but you may not otherwise reproduce, distribute, modify or create derivative works of the Website content without our prior written consent.
"Olivares AI" is a trademark of Francisco Olivares Martín. Nothing on the Website or in these Terms grants you any right to use that mark, or any confusingly similar sign, without our prior written permission.
Open-source code published by Olivares AI remains governed exclusively by its own license, as set out in section 2. Those licenses are not limited or modified by this section.
5. Acceptable use
You agree to use the Website only for lawful purposes and in a manner that does not impair its operation, security or availability, or interfere with any other person's use of it. In particular, you agree not to:
- Access, probe or test the Website by any means that places an undue burden on the service, or that bypasses or attempts to bypass access controls;
- Use automated means to scrape, harvest or systematically collect content from the Website in a way that degrades or disrupts the service;
- Introduce malware, attempt to gain unauthorised access to the Website or its underlying systems, or otherwise misuse the service;
- Use the Website to infringe the rights of others or to violate any applicable law.
6. Responsible disclosure of security issues
If you discover a vulnerability or security issue affecting the Website, please report it responsibly to security@olivares.ai. We support coordinated disclosure and ask that you give us a reasonable opportunity to investigate and remediate before any public disclosure. Further details are available on our security page.
Please do not access, modify or delete data that is not yours, and do not run tests that could degrade the service or affect other users.
7. Third-party links
The Website may contain links to third-party websites and resources, such as the source code repository hosted on GitHub. These links are provided for your convenience only. We do not control and are not responsible for the content, availability, security or privacy practices of any third-party site. Following such links is at your own risk, and the terms and policies of those third parties will apply to your use of them.
8. Limitation of liability
To the fullest extent permitted by applicable law, Olivares AI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your access to or use of, or inability to use, the Website.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for any other liability that the law does not permit to be excluded.
9. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Website or to legal or regulatory requirements. The version published on the Website is the version in force. Your continued use of the Website after an update takes effect constitutes acceptance of the revised Terms. These Terms were last updated on 2026-06-13.
10. Governing law and jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the law of Spain. Subject to any mandatory consumer protection rights you may have, the courts of Toledo shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Website.
